Terms of Service
These Terms of Service (“Terms”) govern your use of thestudiocreative.com (the “Site”) operated by The Studio Creative LLC (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
The Site provides information about our production, web, and marketing services. You agree to use it only for lawful purposes and not in a way that infringes anyone's rights, interferes with others' use, or attempts to gain unauthorized access to our systems.
2. Intellectual Property
The content, layout, design, code, graphics, video, and photography on this Site are owned by The Studio Creative LLC or its licensors and are protected by intellectual property laws. Except as described below, you may not reproduce, distribute, modify, or store our content without our prior written consent.
Portfolio downloads. Where we offer a download or share option on a portfolio video, that file is provided for viewing and sharing as-is. It remains our property or that of the client it was produced for. It may not be edited, resold, used in advertising, or presented as your own work.
Client marks. Client names, logos, and footage shown on this Site remain the property of those clients and appear here to identify work we produced.
3. Services, Quotes, and Agreements
Information on the Site is not an offer or a binding quote. Services are provided under a separate written agreement, proposal, or statement of work that governs scope, schedule, deliverables, fees, revisions, usage rights, and cancellation. Where those documents conflict with these Terms, the signed agreement controls for that engagement.
4. Submissions and Inquiries
When you submit a form on the Site, you confirm the information you provide is accurate and that you are authorized to provide it. Unsolicited ideas or materials you send us are not treated as confidential unless we have a written agreement saying otherwise.
5. Images You Give Us
The mic flag designer can ask for your logo and for a photo of you, and they are handled very differently. A photo of you can also be used in two ways with opposite promises. This section says which is which.
5.1 Your logo or artwork. This one we do receive. When you place an order, the file you upload is sent to us and kept with your order records so we can print from it. If you upload a picture file rather than vector artwork, small samples of it are also sent to an automated image service that reports back how sharp it is. We use your artwork to quote, proof, produce and ship your order, and to keep a record of what we printed. We do not use it to advertise our own business, or show it as an example of our work, unless you tell us in writing that we may.
By uploading artwork you represent and warrant that you own it, or that you have the owner’s permission to use it this way, and that printing it will not infringe anyone’s copyright, trademark, trade secret, right of privacy or right of publicity. You agree to defend, indemnify and hold harmless The Studio Creative LLC from any claim, demand, loss, damage, cost or expense, including reasonable attorneys’ fees, arising out of the artwork you send us or your breach of this section. That applies from the moment we receive a notice or complaint, not only once a claim is filed. We may take over the defense of any such matter at your expense, and you will not settle anything that affects us without our written agreement.
We do not investigate who owns a logo, and we have no duty to. We may refuse or stop any order at any time, including artwork we believe is not yours to use, or that we would simply rather not print. If you believe artwork we have printed infringes your rights, tell us and we will look into it.
5.2 A photo of yourself, placed by you. The “place it yourself” view on the mic flag page lays a picture of your flag over a photo you choose, and you drag it into your hand. That photo is never uploaded. Your browser reads the file from your own device and draws it on your own screen. It is not sent to us, not stored by us, not attached to your order and never used for marketing. Nothing looks for faces in it: there is no face detection, no scan of facial geometry, no measurement, no template and no artificial intelligence of any kind applied to it. Reload the page and the photo is simply gone, because it was never anywhere but in front of you.
Use that view on yourself. By using it you confirm that you are 18 or over, that the photo is yours to use, and that anyone else who appears in it agreed to be in it.
5.3 A photo of yourself, for an AI headshot. The AI headshot view is different, and this photo does leave your device. Only if you tick its box, we send your photo, your logo and a picture of your flag mockup to OpenAI, whose image model creates a new picture of you holding a microphone with your flag. Your photo is made smaller in your browser before it is sent, which also removes the hidden details a camera stores in it, such as location. We use it for nothing but making that one picture: we do not store your photo, and we do not store the result or attach it to your order unless you tick the separate box to send it with your order. If you do, the picture is kept with that order in our customer system and shown on your invoice. We never use either for marketing. OpenAI states that it does not use this data to train its models and may keep it for up to 30 days to check for misuse, under its own terms. Neither we nor our code measures your face or builds any record of your features from it.
The result is an AI-generated picture, not a photograph, and not a proof of your flag. It carries our logo in a bottom corner. It may not look exactly like you or exactly like the flag we print. It is yours to keep and share, but do not present it as a real photograph of a real event, and do not use it to mislead anyone. Use the AI headshot on a photo of yourself only. By using it you confirm that you are 18 or over, that you are the person in the photo, and that anyone else in it agreed to be in it. We may limit how many headshots anyone can make, and we may switch the feature off at any time.
6. Custom Mic Flags
Previews and mockups are illustrations. The 3D mockup, the place it yourself view and the AI headshot are pictures built from your artwork. They are not photographs of your flag and they are not a proof. A printed part is a physical object: it carries fine layer lines, a matte finish and a visible seam where each layer starts, and small details may be thickened or simplified so they survive printing.
Colour is matched, not guaranteed. No two screens agree with each other, and none of them is plastic. We match your colour to the nearest filament we can get. We do not guarantee an exact match to a Pantone number, a hex code, your screen or a previous order, and a reasonable variation in colour is not a defect.
The proof is what you are approving. Before anything is printed we send you a proof. Check the spelling, the artwork, the colours, the quantity and the size. Once you approve it we produce exactly what it shows, and we are not responsible for an error that was on a proof you approved. Because each flag is made for you alone, an order can be cancelled up to proof approval and not after.
Artwork we redraw. We print from vector artwork. If you send a picture file and agree to the logo recreation fee, we redraw it by hand and show you the result on the proof for your approval. You may use that redrawn file on anything we produce for you.
What you receive. Flags are 3" x 2" x 2" with a 1.34" bore and fit most standard handheld microphones. The microphone is not included. Minor variation in dimensions, finish and logo placement is normal for a printed part and is not a defect.
Timing. Where we state a production and shipping time, we ship within it. If we do not state one, we will ship within 30 days of your proof approval, or contact you with a new date and your right to cancel for a full refund.
Returns and replacements. Every flag is made for one customer, from one customer’s artwork, so once you have approved the proof we cannot take it back and resell it. Changing your mind after that point is not a refund. Up to proof approval you can cancel for a full refund, so the proof is the moment to look closely.
That is a different thing from us getting it wrong. If your order arrives damaged, faulty, or simply not what the approved proof showed, we replace it or refund it at our own cost, and you do not pay to send anything back. Email us a photograph of the problem within 5 days of delivery. The photograph is not us being difficult: it is what lets us file a claim with the carrier for transit damage, and what tells us what to fix on our end if the fault is ours. We will send you a prepaid label and settle the refund or the remake once the items reach us. Please talk to us before posting anything back, so we know it is coming and you are not out of pocket.
After 5 days from confirmed delivery we take it that the order arrived as it should have, and the return window closes. Beyond that, a printed flag is a physical object in a working environment: we stand behind ordinary use and the odd knock, but not a flag that has been run over, crushed in a case, left baking on a dashboard, or otherwise had something happen to it that would have finished off anything else in the bag.
NO WARRANTIES ON GOODS. EXCEPT AS STATED IN THESE TERMS, MIC FLAGS AND ANY OTHER GOODS WE MAKE ARE PROVIDED “AS IS”. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
Our liability for an order. Our total liability for any order, on any theory, will not exceed what you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost bookings or the cost of a missed event. Any claim about an order must be brought within one year of the day it shipped.
Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, fraud, or personal injury in the case of consumer goods. Some states do not allow some of these exclusions, so parts of this section may not apply to you, and nothing here waives a right your state gives you.
7. The Peptide Compliance Checker
What it is. The Peptide Compliance Checker is a free, automated tool. It reads up to eight public pages of the website you enter and has an AI model (Anthropic’s Claude) review their text against a library of published FDA, FTC, payment processor and ad platform rules that we research every week. It reports wording that may create risk, suggests replacement wording, and runs simple checks a payment processor might.
Your permission. By running a check you confirm that you own the website you enter or are authorized by its owner to review it, and that the name and email you give are your own. Do not use the checker on a site you have no right to review, to collect other people’s content, or in a way that overloads any website. We may limit or refuse checks to keep the tool available.
Not legal advice, and no guarantee. The report is general information produced automatically. It is not legal advice, it does not create an attorney-client relationship, and it is not a review by a lawyer or a regulator. It may miss risks, and it may flag wording that is acceptable. The score is arithmetic on what was found, not a legal judgment. Following its suggestions does not guarantee that the FDA, the FTC, a payment processor, an ad platform or anyone else will approve, keep or not act against your business. Have anything important reviewed by an attorney who works with FDA-regulated products.
Your report. Your report is shown in your browser and emailed to you, and you may keep and use it. We keep a private copy, with a record of who it was emailed to and whether the email was opened, so we can help you with it; it is never published and has no public link. The report may include screenshots of public pages of the site you checked, taken only to show where each finding is. See our Privacy Policy.
Changes. We may change the checker, its rules or its limits, or withdraw it, at any time. The checker is provided as is, and sections 9 and 10 below apply to it.
8. Third-Party Content and Links
The Site links to and embeds third-party services and websites. We do not control them and are not responsible for their content, availability, or practices. Links are not endorsements.
9. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on it is complete or current.
Nothing on this Site is legal, financial, medical, or regulatory advice. Marketing results described in case studies reflect specific engagements and are not a guarantee of comparable outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, The Studio Creative LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Site. Our total liability relating to the Site will not exceed one hundred dollars ($100). Liability arising from contracted services is governed by the applicable client agreement.
11. Indemnification
You agree to indemnify and hold harmless The Studio Creative LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.
12. Privacy
Our Privacy Policy explains how we handle personal information and is incorporated into these Terms.
13. Changes to the Site and Terms
We may modify or discontinue any part of the Site at any time, and we may update these Terms by posting a revised version with a new “Last updated” date. Continued use after changes means you accept them.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Genesee County, Michigan, and you consent to their jurisdiction.
